Some Myths About Probate
In California, probate court is the division of the court system that supervises distribution of estates to heirs. Probate is a process that most people don’t know anything about until they need to because a loved one has died. There are many common misconceptions about the probate process in California. All of the following statements are false, for example:
- An estate executor or administrator doesn’t need permission to distribute assets.
- If there was a will, then there will not be a probate proceeding.
- The probate court does not monitor the executor’s actions.
